Welcome to the Cloud Paradigm website and customer portal (the "Platform"). By accessing or using this Platform, you agree to be bound by these Terms & Conditions (the "Terms"). If you do not agree, please do not use the Platform.

1. About Us

Cloud Paradigm Pty Ltd (ABN 27 664 436 882) ("Cloud Paradigm", "we", "us", or "our") is an Australian company providing Azure cloud consulting services. Our registered business operates under the laws of the Commonwealth of Australia.

  1. To access certain features of the Platform, you may be required to create an Account using Microsoft Entra External ID authentication.
  2. You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account.
  3. You must provide accurate and complete information when creating your Account and keep your information up to date.
  4. You must notify us immediately at info@cloudparadigm.com.au if you become aware of any unauthorised access to or use of your Account.
  5. We reserve the right to suspend or terminate your Account at any time, with or without notice, if we reasonably believe you have breached these Terms.

5. Intellectual Property

  1. All Content on the Platform, including but not limited to text, graphics, logos, icons, images, software, and design, is the property of Cloud Paradigm or its licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws.
  2. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any Content without our prior written consent, except as permitted by these Terms or applicable law.
  3. The Cloud Paradigm name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Cloud Paradigm. You must not use such marks without our prior written permission.

6. Customer Portal

  1. The customer portal provides authenticated users with access to project-related information, documentation, and resources specific to their engagement with Cloud Paradigm.
  2. Access to portal content is granted on a per-user basis. You may not share your Account credentials or allow others to access the portal through your Account.
  3. Content made available through the portal may be confidential. You agree to treat all portal content as confidential and not disclose it to any third party without our prior written consent, unless otherwise specified in your service agreement.

7. Privacy & Data Collection

  1. We collect and process personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
  2. When you create an Account or use the contact form, we may collect your name, email address, company name, and other information you provide.
  3. We use Microsoft Entra External ID for authentication. Your authentication data is processed by Microsoft in accordance with their privacy policies.
  4. We do not sell, rent, or trade your personal information to third parties for marketing purposes.
  5. We may use cookies and similar technologies to improve your experience on the Platform. By using the Platform, you consent to the use of cookies.

8. Third-Party Services

The Platform may integrate with or contain links to third-party services, including Microsoft Azure, Microsoft Entra ID, and other cloud services. We are not responsible for the content, privacy practices, or availability of any third-party services. Your use of third-party services is subject to their respective terms and conditions.

9. Disclaimer of Warranties

  1. The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.
  2. To the maximum extent permitted by law, Cloud Paradigm disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  3. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  4. Any information or advice provided through the Platform is for general informational purposes only and does not constitute professional advice. You should seek independent professional advice before making any decisions based on such information.

10. Limitation of Liability

  1. To the maximum extent permitted by applicable law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), Cloud Paradigm shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the Platform.
  2. Our total aggregate liability to you for all claims arising out of or related to these Terms or your use of the Platform shall not exceed AUD $100.
  3. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud, death, or personal injury caused by negligence, or guarantees under the Australian Consumer Law that cannot be excluded.

11. Indemnification

You agree to indemnify, defend, and hold harmless Cloud Paradigm, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your breach of these Terms, or your violation of any applicable law or the rights of any third party.

12. Termination

  1. We may terminate or suspend your access to the Platform at any time, with or without cause, and with or without notice.
  2. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall continue in effect, including Sections 5, 9, 10, 11, and 14.

13. Changes to These Terms

  1. We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform.
  2. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
  3. We encourage you to review these Terms periodically to stay informed of any updates.

14. Governing Law & Jurisdiction

  1. These Terms are governed by and construed in accordance with the laws of South Australia and the Commonwealth of Australia.
  2. You agree to submit to the exclusive jurisdiction of the courts of South Australia and any courts of appeal therefrom for the resolution of any disputes arising under or in connection with these Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with any applicable service agreements between you and Cloud Paradigm, constitute the entire agreement between you and Cloud Paradigm regarding the use of the Platform and supersede all prior agreements and understandings.
